Mayor Chrystal Eckel is not one to sit idly by. She and her city council are known for their accomplishments, and this time, they took a stand on issues currently being debated nationally as well as in Texas.

Showing its mettle, the small but influential city of Poth, Texas, has once again taken a positive leadership role by passing two resolutions on subjects widely viewed as controversial. Would that all cities, counties, and states follow that lead; if so, the message could be carried all the way to Washington.

In a meeting last week, the Poth City Council passed a resolution in support of HCR 50.

The resolution reads in part: HCR 50 affirming that the State of Texas is serving notice to the federal government to cease and desist certain mandates; and Whereas, Texas State Legislature HCR 50 affirming that the State of Texas is providing that certain federal legislation be prohibited or repealed,” the council “provides its wholehearted support” and encourages its passage by the state legislature.

Texas is one of more than a dozen states that have gone on record in response to Congress’ passage of the Obama administration’s stimulus bill. They see it as a direct assault on the rights of states to reject the money coming from the federal government. Several states have invoked the power of the 10th Amendment in a bid to protect themselves from what they view as nothing less than an unconstitutional usurpation of power on the part of the Obama administration.

For those not familiar with the 10th Amendment, it reads: The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.
In another vote, the Poth City Council approved a resolution in opposition to HR 45, known as Blair Holt’s Firearm Licensing and Record of Sale Act of 2009, which amends the Brady Handgun Violence Prevention Act.

Following in the footsteps of the Wilson County commissioners, who went on record in opposition to HR 45 in a March 9 meeting, the Poth City Council voted to oppose HR 45, as well as support states’ rights.

The controversial HR 45 would prohibit a person from possessing a firearm without a firearm license. It also would mandate that all sales be processed through licensed dealers, effectively prohibiting gun sales between individuals.

Hunters and gun owners are rightly outraged by this proposed legislation. Some are calling it the mother of all gun-control bills.

It prescribes strict penalties for failure to report all gun transactions, including individual address changes, and prohibits keeping a loaded firearm -- or an unloaded firearm and ammunition for the firearm -- “knowingly or recklessly disregarding the risk that a child could gain access.” It would establish and maintain comprehensive databases concerning all accidents, sales, production, and distribution of firearms.

Such gun-control legislation is seen by many as a direct attack on Second Amendment rights. The Second Amendment reads: A well-regulated Militia being necessary to the security of a free State, the right of the people to keep and bear arms shall not be infringed.

Kudos to Wilson County commissioners and to the Poth City Council. Let’s challenge other cities and counties to join in this effort at states’ rights and Second Amendment protection.
