Council takes stand, supports states’ rights

POTH -- In response to recently proposed legislation in the U.S. Congress, the Poth City Council unanimously passed two resolutions at its March 16 meeting that are aimed at preserving states’ rights.

The first resolution mirrors one recently passed by the Wilson County Commissioners Court, which seeks to encourage the U.S. House of Representatives to grant disapproval of HR 45, known as Blair Holt’s Firearm Licensing and Record of Sale Act of 2009. The bill seeks to amend the Brady Handgun Violence Preservation Act of 1993 by creating federal criteria for owning, licensing, and transferring firearms.

According to a signed copy of Poth’s resolution, the four councilmen in attendance voted in favor.

“We think the right to bear arms is a constitutional right given by our forefathers and we don’t think anybody should be messing with it,” said Mayor Chrystal Eckel in a March 18 telephone interview. “The government shouldn’t be messing with our rights.”

The vote count was the same when the council approved a resolution supporting House Concurrent Resolution (HCR) 50, which is currently in the Texas State Legislature. HCR reasserts Texas’ sovereignty under the 10th Amendment. It also asks the federal government to “cease and desist” any mandates that could be perceived as usurping states’ rights or are beyond its constitutionally designated powers.

“The federal government can’t tell us how to make our state’s decisions,” Eckel said.

If passed by both the state House and Senate, copies of HCR 50 will be forwarded to President Obama, Vice President Joe Biden, House Speaker Nancy Pelosi, and all federal lawmakers elected from Texas with the request that it be placed into the Congressional Record.
