A 22-year-old La Vernia man has been charged with one count of intoxication manslaughter for his alleged role in a Sept. 17, 2008, crash that claimed the life of a 46-year-old Nixon man.

As of press time Monday, Francisco S. Servin was being held in the Wilson County Jail on $75,000 bond, a jail official said. Servin was taken into custody July 19, six days after a Wilson County grand jury indicted him.

The indictment alleges that Servin was legally intoxicated when his vehicle crossed the centerline of U.S. 87 in front of the La Vernia Chamber of Commerce park and collided almost head-on with a motorcycle ridden by Henry Paul Dingler Jr. (see article, Sept. 24 Wilson County News).

An arrest did not follow immediately after the crash because Servin was not with his vehicle when law-enforcement officials arrived at the scene. Troopers from the Texas Department of Public Safety (DPS) Highway Patrol said earlier that blood evidence found inside Servin’s 2003 Ford Taurus was sent for testing by a DPS crime laboratory in Corpus Christi.

“We now have sufficient evidence to prove he was at the scene,” said Audrey Louis, assistant district attorney for the 81st Judicial District. “We believe we have sufficient evidence to prove he was the operator of the vehicle.”

Louis would not specify Servin’s exact blood-alcohol level, but she said it was “above the legal limit” of 0.08.

If found guilty, Servin faces two to 20 years in prison and a fine of up to $10,000.

If he is such a good kid - he should "man up" - it was his vehicle, a man is dead, and he's playing dumb - go figure.
