A question for taxpayers

I have recently attended the two Public Hearings conducted by the City of Floresville on their proposed property tax rate. The Mayor and city staff continually regurgitated the rhetoric that they are not raising our taxes as the tax rate is not changing. The truth is that property values in the City of Floresville have increased, therefore if the City maintains the same tax rate we will be paying more in property taxes.

The Texas Tax Code is actually written quite well and protects the tax payers for this very issue. The guide published by the Texas Comptroller for taxing entities “2011 Truth-In-Taxation” requires the City of Floresville (or any taxing entity for that matter) to calculate a baseline called the “Effective Tax Rate”.

The Effective Tax Rate is a baseline based upon current property values that would generate the same amount of property taxes that the City of Floresville received last year. So, if property values increased the Effective Tax Rate would be lower than last yearʼs tax rate and if property values decreased the Effective Tax Rate would be higher than last years tax rate. End result, regardless of property values, the Effective Tax Rate would generate the same amount of taxes as the City of Floresville collected last year.

The Texas Tax Code requires the taxing entity to compare their proposed property tax rate to this ʻEffective Tax Rate” and if their proposed property tax rate is higher (i.e. their proposed property tax rate will generate more taxes than the previous year) they must publish this information, hold public hearings and vote to adopt this proposed tax rate.

Well, the City of Floresville did publish two one-quarter page Notices of Public Hearings in the Wilson County News. One on September 7th of this year and the second on September 14th. These notices stated that the effective tax rate is $0.1600 per $100 of taxable value, the baseline tax rate that would generate the same amount in property taxes that the City received last year. These notices also stated that the proposed property tax rate is $0.3227 per $100 of taxable value.

According to these notices the proposed property taxes will be more than double that of last year. In the Public hearings when questioned about these notices both the City Finance Director and Constituent Liaison stated that these notices were correct and without error.

If it is true that these notices were correct, how can a taxing entity more than double the amount of property taxes without recourse from the taxpayers?

If these notices were incorrect, should the City republish the notices, reschedule public hearings and provide to the taxpayers the truth about this proposed tax rate?
