This is the response I received from Ms. Connie Rose when I questioned her about Sherri Pollock's statements that the Notice had been reviewed and approved by the Office of the State Comptroller:
"Dear Mr. Miller:
I have not reviewed the City of Floresville’s calculations or notice regarding truth-in-taxation, nor have I said it was in compliance. I did speak with Fonda Kellner on September 14. I explained the requirements of the Occupations Code Chapter 1151.151 about being registered as a Registered Texas Assessor-Collector and quoted Tax Code Sections from Chapter 26 that were relevant to the truth-in-taxation process, specifically 26.04 (g) and 26.05 (e). At no time did I say they were in compliance, correct or express any opinion about the City of Floresville’s calculations or notices. I was told by Ms. Kellner that they would seek the advice of their attorney.
Connie Rose
Information Services Team Lead"
You might also note that the Tax Code Sections 26.04 (g) and 26.05 (e) both relate to the taxpayers right to file an injunction against the city for non compliance with the calculation and notice requirements of the Tax Code.
