Letter: Don’t dump oil-field waste here

Editor:

We, as concerned citizens, are reaching out for solutions as big money forces now threaten our quiet peaceful neighborhood. Our life and environment are both jeopardized by a proposed commercial oil-field dumpsite.

The permits have been applied for and, if the Railroad Commission approves, the dumping will begin. We have protested to the Railroad Commission, the EPA, TxDOT, and local authorities.

The Wilson County Commissioners Court in Floresville and a local oil man assured the citizens no damages to our water, roads, or way of life would occur. They urged us to drop the protest for several reasons. Primarily, the cost of fuel would double if citizens continued to fight against these type of operations.

We have several questions that remain unanswered at this point.

Specifically, who is responsible for the type of material dumped into this well? Rules to stop illegal dumping of waste are only effective if regulations are actively enforced. Currently, there will be no testing of dumped products or tanker products as they arrive at the site.

Specifically where this product ends up in the earth below is still a mystery. We have been told by some not to worry, because we will all be dead when they find it!

Specifically, who personally provides the necessary financial protection in the event of equipment failure? If the well casing or equipment used during this process fails, and the waste products are dumped above ground or out in the formation, who pays for the recovery of dumped waste and destruction of property?

In previous events, the major oil companies have the resources to provide the needed repairs. Smaller companies can run short financially, and leave the taxpayers and landowners to the task of cleaning up.

The current owner of the proposed site near La Vernia is a limited liability corporation. The liability is limited and when the insurance money is gone, the corporation is not legally responsible for whatever is left behind.

We were also assured the Eagle Ford shale companies would not be using this dumpsite. The residents of Kothman Road have cautioned us in that regard. Recently, their once-quiet neighborhood was changed due to the commissioners court approving through traffic on their road. The former dead-end road was opened and now Eagle Ford shale trailer park sewage is hauled through their neighborhood in mass amounts to the sewage plant behind their subdivision. The constant flow of 18-wheelers now keeps noise and traffic in the forefront of their daily lives.

The very small number of individuals making huge amounts of money are doing great. The rest of us will continue to pay higher fuel prices and be expected to step aside and allow those profiting to dump their waste products in our county. It is extremely difficult to understand those who tell us this waste material is harmless, when it is titled waste disposal and pumped under pressure deep into the earth.

We ask for your suggestions, prayers, and help to stand for our God-given rights to unite and stop those who we feel threaten our normally peaceful way of life.

JIMMY STEVENS

La Vernia

Private property rights do not actually give you the right to do whatever you want with the property. Knowing that there are 596 chemicals in the fracing process I think it best that whatever is dumped in there be thoroughly ... More ›
