using the income tax system to enforce mandatory health insurance is absurd. I really do like the idea of universal healthcare, however, I think this mandate is unconstitutional. Additionally adding authority to the irs is like the last thing this nation needs. We needed to start this endeavor with income tax reform, get our revenue straight - then figure out what we can afford.

everyone needs to pay taxes, before we can figure out how to pay for their medical.

There is a way around the tax penalty. Just don't overpay your taxes and they can't withhold your return. But, that will only affect a small number of people, really. There are several pages of exemptions for all the "special people", (Obama voters).

Plus, the penalty is such a small amount, those who don't get insurance and pay the penalty will still be a burden on the system, albeit a negligible one, so the whole thing is a joke.

It will be struck down. Too bad the Court doesn't have the power to punish the Congress for passing it.

They say the government will pentalize those who do not comply. As I understand it - this will be done through our income tax return.

The first flaw is - the last time I look - dope dealers don't file income tax. Dope fiends don't file income tax returns. Street people don't file tax returns. People that work "under the table" don't file tax returns. Those are just a few - right off the top of my head. Oh, yeah, Illegals don't file tax returns.
These are the very people that are more than likely to end up in the ER.
So, I ask - where is the fairness in this hair brain idea.?? ... And how come that question has not come up in the Supreme Court hearings. At least - I have not heard this sort question.

Of course it's unconstitutional. Most of what the federal government does is unconstitutional, except that 235 years of crappy, stupid interpretations and about 70 years of down right socialist driven activism has created so many precedents that the lawyers can declare almost anything constitutional.

When you read the actual words of the interstate commerce clause, it is perfectly clear what the intent was. It was to solve commerce disputes between the states, not solve the cost of health care insurance, or provide free health care to the entire Democrat voter base.

But, between the agendas of the Left and the sacred almighty, all knowing lawyers arguing over the meaning of "is"... or, commerce, it is no wonder that the country is as screwed up as it is.

It is obvious that the framers never intended for the government to be allowed to spend itself into bankruptcy, but here we are - dead broke with no political will to stop the suicidal spending that keeps our corrupt politicians living like royalty for life.
