New rules in effect for sexually oriented businesses

The increasing flow of oil- and natural gas-related disposable income in South Central Texas continues to create abundant opportunities for small-business owners and large-scale investors alike. Hotels and recreational-vehicle (RV) parks also continue to spring up throughout the Eagle Ford shale region, in an effort to provide housing for the thousands of workers still arriving.

While cities and counties are struggling to meet the planning, zoning, and infrastructure challenges of this population boom, officials also are realizing that many locales have no regulations related to sexually oriented businesses.

Poth Mayor Travis Pruski said during the April 10 meeting of the Poth Planning and Zoning Commission that City Hall already had received three calls inquiring about that city’s regulations on that type of establishment. This prompted the Poth City Council April 16 to amend its planning and zoning ordinance to address such establishments. No one, however, has submitted applications related to opening a gentlemen’s club or other adult entertainment venue in the small town of less than 2,000 residents.

“I think telling them we’re working on this, the conversations are short and quick,” he said.

Karnes County Judge Barbara Shaw said April 19 that she also has had at least three inquiries over the past couple of months about her county’s rules from parties wishing to establish gentlemen’s clubs.

“This made us realize we had to get our regulations in place because we didn’t want to get caught,” she said.

The Floresville City Council has had a similar ordinance on the books since 2003, while McMullen and Live Oak counties adopted regulations related to sexually oriented businesses in February and March, respectively, according to stories in The Progress. Bee and Karnes counties recently passed the same regulations as McMullen County, Shaw said.

The Wilson County Commissioners Court began work on regulations for unincorporated areas of Wilson County April 9.

Pruski cited the example of Cotulla. The town is located 29 miles from Encinal, where the Barebacks gentlemen’s club opened last year just off I-35. The club, which also is a bar and grill, was featured in an August article in the San Antonio Express-News.

A manager at Barebacks, identifying himself as “Stewart,” said the club no longer has female exotic dancing as of earlier this month. It now operates solely as a restaurant and bar. The manager reserved additional comment for the club’s owner, Beca Howard, who was not available for comment.
