City bans senior citizen from council meetings

FLORESVILLE -- Prior to the June 21 special meeting of the Floresville City Council, officers with the Floresville Police Department removed a 70-year-old woman from the proceedings, after she was served with a criminal trespass warning.

Deci Murphy of Floresville was asked to leave and not return, following an incident at the June 14 regular city council meeting, where she confronted Councilman Sherry Martinez Castillo about budget and finance issues raised during previous council meetings.

According to a police report, Sgt. Daria Fowler said she was contacted by Lt. Jesse Evins to attend the Floresville City Council meeting, due to some of the citizens getting overly emotional.

Once on the scene, Fowler met with Castillo, who said Murphy had “thrust a piece of paper at her” and that, pertaining to the city audit, Castillo should “know better” because she had a background in bookkeeping.

Castillo reported to Fowler she was very taken aback and frightened by Murphy’s “aggressive behavior.”

Fowler advised Castillo and City Manager Andy Joslin that a criminal trespass warning could be issued to the woman if she decided to return.

Citing section 30.05 of the Texas Penal Code, the report indicated Joslin would inform Murphy in writing and orally that she was not to return to the council chambers.

“The officers who removed me from council chambers were very polite and in my opinion were embarrassed by having to do so,” Murphy said later. “I just celebrated my 70th birthday. All I did was ask why, with [Castillo’s] background in banking, she wasn’t able to see something was going on. I was not threatening in any way.”

Floresville businessman Jim Miller, who has represented many of the citizens of Floresville at meetings, said he was disappointed in what happened to Murphy.

“Before the very meeting where they adopted Robert’s Rules which call for civil discourse, they blatantly do this,” Miller said. “Despite the fact that this is a violation of her civil rights and her constitutional right to participate in local government, this is clearly an exercise in intimidation by the city. In that same meeting, I said that an action item was a blatant slap in the face of the voters of the city of Floresville. How is that any worse than what Deci said? It’s not; it’s equivalent. How can you ban a citizen from a public meeting in a public place just for standing up and asking questions?” As of press time June 25, Joslin had not responded to requests for comment.
