FLORESVILLE -- Jim Miller, a Floresville businessman who was thwarted in his attempt to be a candidate in the upcoming election for Floresville City Council Place 1, has taken his fight to court.

Miller’s attorney, Eric Opiela, today filed a petition for writ of mandamus with the Fourth Circuit Court of Appeals in San Antonio, in an attempt to compel City Secretary Margaret Aranda -- Floresville’s election judge -- to place Miller’s name on the ballot. He also is requesting Aranda withdraw her administrative determination of ineligibility, alleging she exceeded her authority under the law.

Aranda, at approximately 5:30 p.m. Aug. 20, informed Miller that he was ineligible to run in the election, alleging he has not resided within Floresville for one full year. This was because Miller registered to vote in Floresville in June, despite indicating on his nominating form that he has been a city resident for 5 years, 8 months.

Alicia Pierce, a spokesman for the Secretary of State’s office, said yesterday, “There is no obligation to establish residency through voter registration.”

Attempts by this newspaper to reach Aranda have been unsuccessful.
