FLORESVILLE -- Floresville businessman Jim Miller is officially a candidate for Floresville City Council Place 1, following a brief absence from the Nov. 6 election ballot.

Miller filed Aug. 13 to seek election to the seat currently held by incumbent Jesse Christopher Flores, who is seeking his third, two-year term. But on Aug. 20 at 5:30 p.m. -- a half hour after the filing deadline -- the city’s municipal election judge, City Secretary Margaret Aranda, notified Miller that he was ineligible to run. She barred Miller because Miller only registered to vote in Floresville in June, despite indicating on his application that he has been a city resident for 5 years, 8 months.

Alicia Pierce, a spokesman for the Secretary of State’s office, said yesterday, “There is no obligation to establish residency through voter registration.”

Miller and his attorney, Eric Opiela, filed a petition for a writ of mandamus Aug. 21 with the Fourth Circuit Court of Appeals in San Antonio, in an attempt to compel Aranda to place Miller on the ballot.

Wilson County Attorney Russell Wilson also filed an amicus curiae -- Latin for “friend of the court” brief, arguing that the city allowed Aranda “to perform a judicial gatekeeping function regarding access to the ballot,” which violated “constitutional protections against arbitrary and disparate treatment of voters.”

Floresville City Attorney Louis T. Rosenberg rendered Aranda’s response on her behalf, in which he said Miller would be placed on the election ballot. The court also ordered Aug. 24 that Aranda place his name on the ballot.

The controversy surrounding Miller’s exclusion from the ballot was the topic of discussion in area restaurants and online. After being allowed to remain on the ballot, Miller posted a comment on the Wilson County News’ website.

“Now that this issue of being on the ballot in November is closed we can move on to discussion of the issues,” he wrote.
