Attorney seeks dismissal of suit against Floresville council

FLORESVILLE -- An attorney representing Floresville city councilmen Mario Morones and John W. Guerrero is asking the 81st Judicial District Court to dismiss the suit filed against the council by Mayor Daniel Tejada.

Eric Opiela this morning filed a plea to the jurisdiction and a motion to dismiss. He claims that:

•Morones, Guerrero, and fellow councilmen Jesse Christopher Flores and Sherry Martinez Castillo cannot be sued individually because of actions they take as a council.
•Tejada, under the city’s home-rule charter, lacks the authority to bring suit against the council.
•Tejada’s claims of irreparable harm to the city are hypothetical, referring to events that have not yet occurred.

On Sept. 7, Tejada filed suit against the four councilmen, because city council meetings for the past month have been canceled for lack of a quorum and the lack of a presiding officer. The suit alleges that their absence has limited “... the ability of the city to function, namely to set a budget and collect taxes, and this will cause immediate and irreparable harm to the residents of the city,” and it seeks to compel Flores, Castillo, Morones, and Guerrero to attend city council meetings. A hearing on the case is scheduled for Thursday, Sept. 13, at 9 a.m., in Wilson County District Court.

I really hope the judge allows this mess to go to trial. I want the popcorn concession. That would be the best comic theater in South Texas since Possum Clark's place burned down.
