Letter: Difference between legal, legitimate power

I was shocked and appalled to read the front-page story on Sept. 12, titled “Tejada Sues Floresville Council Members.” It seems the tyrant who occupies the mayor’s office in Floresville is suing councilmen Jesse Flores, Mario Morones, John Guerrero, and Sherry Castillo.

It appears as though Mayor Tejada and Floresville Economic Development Corp. (FEDC) Executive Director Jesse Perez -- who is not a resident of Wilson County and therefore will not be subject to tax increases -- want to build a sports complex, costing millions of dollars, against the wishes of their constituents.

It is also apparent from the Wilson County News article that the people of Floresville have exercised their God-given right to petition the city council for a vote on the sports complex. It is quite clear what the First Amendment says on this matter, that the people have “the right to peaceably assemble, and to petition the Government for a redress of grievances.”

According to news reports, the city council and the FEDC have agreed to circumvent the wishes of the citizens by going around the “certificates of obligation” specified in the petition! These actions are appalling for a banana republic, but shocking in Texas!

All fair-minded citizens realize our elected officials must, by virtue of their position, exercise power. There is a clear difference between legal power and legitimate power. Our Founders only recognized, and codified into our Constitution, the exercise of just (or legitimate) powers. Just powers are defined to be “from the consent of the governed.” Thomas Jefferson wrote, in the Declaration of Independence, that government powers must be just when he wrote, “Governments are instituted among Men, deriving their just powers from the consent of the governed.”

Just prior to the ratification of our Constitution, Alexander Hamilton wrote “Federalist 22,” where he defined the type of power given to our new government. He wrote, “The fabric of the American empire ought to rest on the solid basis of the Consent of the People. (Emphasis in the original document.) The streams of national power ought to flow immediately from that pure, original fountain of all legitimate authority.”

It is clear from his actions that Mayor Tejada has not exercised legitimate authority. Mayor Tejada may argue that what he is doing is legal, but it certainly is not legitimate. His actions prove he is more of a tyrant than a mayor. I urge the citizens of Floresville and of Wilson County to vow to never re-elect Mayor Tejada to any future position of trust. In my opinion, his actions prove he is not trustworthy.

Factsonlyplease, yes we voted for the mayor and contributed to his campaign. That does not mean that we don't now regret it. And yes, we even voted for Castillo and Flores. Fool me once, shame on me, fool me twice, shame on you!!!!!
