Judge finds man guilty of stabbing roommate to death
Judge Stella Saxon of the 218th Judicial District has found a Graytown man guilty of the Feb. 15, 2011, stabbing death of his roommate.
Saxon, at the conclusion of 26-year-old Ramon Lopez’s two-day trial Sept. 27, ordered that he return to court for sentencing Oct. 30. He could face life or 5 to 99 years in prison, according to Assistant District Attorney Audrey Louis of the 81st Judicial District. Pronouncement of his sentence will follow a pre-sentence investigation.
Court testimony indicated that the slaying occurred after the two men, who were involved in an intimate relationship, became involved in a violent dispute. If Lopez’s attorney Richard Briggs is successful in arguing that his client acted in “sudden passion,” Louis said the punishment range could be reduced to 2 to 20 years in prison.
Section 19.02 (a)(2) of the Texas Penal Code defines sudden passion as “... passion directly caused by and arising out of provocation by the individual killed or another acting with the person killed which passion arises at the time of the offense and is not solely the result of former provocation.” Louis said it also relates to “anger, rage, resentment, or terror.”
Lopez is guilty of the murder of 57-year-old Jose Antonio Hernandez, after the victim was found stabbed to death inside the home the two men shared on F.M. 2579 near the intersection of Mariana Road. Lopez called 911 just after 1 a.m. to report that he found Hernandez’s body lying in a pool of blood on the floor. But the subsequent investigation by the Wilson County Sheriff’s Office led deputies to allege that he was the one who stabbed Hernandez several times in the neck.
Other defendants set for jury selection Sept. 24, but rescheduled, were:
•Bobby Schroeder, 28, of Floresville, who is charged with aggravated robbery, aggravated kidnapping, and burglary of a habitation with intent to commit aggravated robbery, for his alleged role in a March 15 incident in Floresville. He now is being represented by attorney Robert Barrera, and is set to return to court for a pretrial hearing Dec. 11.
•Jordan Robert Lewis, 19, of San Antonio, who is charged with aggravated robbery, attempted aggravated kidnapping, escape, evading arrest or detention with a vehicle, and unauthorized use of a motor vehicle following a March 3 escape from the Wilson County Jail. He is set to return to court for a docket call Oct. 4, ahead of jury selection Oct. 15.
