Dec. 10 trial date set for suspect in fatal hit-and-run
Jury selection in the trial of 23-year-old Rafael Alfaro III of Floresville is set to begin Dec. 10. This is according to the Wilson County District Clerk’s office, following Alfaro’s Nov. 7 arraignment.
Alfaro is charged with failure to stop and render aid after being involved in an accident resulting in death or serious bodily injury, following a July 28 incident that ended with the death of 53-year-old Richard “Tiger” De Leon of Floresville. Court records indicate that he has retained attorney Stephen Barrera.
Alfaro’s next court appearance is a pretrial hearing set for Nov. 29, followed by a Dec. 5 docket call.
Also arraigned was 34-year-old Monica Olivo of Floresville, who is charged with theft by a public servant, totaling more than $20,000 but less than $100,000, in connection with alleged thefts that occurred on or about Oct. 21, 2009. This was while she was an employee of the Wilson County Tax Assessor/Collector’s Office in Floresville. Court records indicate that jury selection in Olivo’s trial is set for Feb. 19.
Her next scheduled court appearance is a pretrial hearing set for Jan. 16, with a docket call set for Feb. 5.
Two other defendants set for arraignment Nov. 7 were rescheduled, because their attorneys were unable to attend. They were:
•Maria E. Wildenstein, 48. The former La Vernia Junior High School prinicipal is charged with misapplication by a fiduciary for allegedly misapplying 23 separate checks totaling more than $20,000 but less than $100,000. Her arraignment was reset for Nov. 22. Wildenstein has retained Lorraine Efron as her attorney.
•Benjie Burke III, 24, of Gilmer, who is charged with intoxication manslaughter for his alleged role in the Jan. 21 death of his passenger, 30-year-old Justin Gregory Jones. His arraignment was reset for Dec. 5. Burke has retained Roy Barrera Jr. as his attorney.
In an unrelated matter, the case against a man charged with aggravated assault with a deadly weapon has been dismissed. Court records indicate that the case against Carlos Barrera-Alvarado, 54, of Floresville was set for docket call Oct. 30. However, the illegal immigrant was deported back to his native Guatemala.
Police said Barrera-Alvarado struck a man with his vehicle in retaliation for a March 18 fight outside Big Dan’s Bar in Floresville. Assistant District Attorney Audrey Louis of the 81st Judicial District said her office was unable to proceed with the case without the victim’s testimony.
