Judge quashes suit against FEDC

A suit filed by Wilson County Attorney Russell Wilson against the members of the Floresville Economic Development Corp. board has been dismissed. The decision came in an order granted Nov. 19 by Judge Fred Shannon in the Wilson County District Court.

Shannon -- the senior judge of the 131st Judicial District, who was assigned Oct. 16 to preside over the case -- ruled that Wilson lacked the authority under his official capacity to file the suit. The FEDC’s attorney, David West of the firm of Cox Smith Matthews, successfully argued that Wilson cannot act in his official capacity unless it was first approved by the Wilson County Commissioners Court. However, Wilson could have proceeded with the suit if he had filed it as a private citizen.

Wilson contended that he had authority to file the suit under Section 41.009 of the Texas Government Code. This statute allows a county attorney, under certain circumstances, to file suit against an officer entrusted with the collection or safekeeping of public funds. He alleged in his suit that FEDC board members Wilfredo Amaro, Gavino Cantu, Alfred Gonzales, David Longoria, Sarah J. Mendoza, Juan Ortiz, and Rebecca Silva Freudenberg violated the Texas Open Meetings Act July 23 when they voted to borrow $2.1 million to give to the city of Floresville to finance construction of an outdoor sports complex.

The county attorney said that he is unsure how he will proceed in the matter, since the outcome of Floresville’s recent municipal election has rendered discussion of the proposed sports complex a “moot” issue.

Highly qualified, business people placed on the FEDC Board. How exciting!!! A step in the right direction. Now we will know exactly what is going on. Maybe they will be able to figure out how the 1.5 million dollars was spent!!!
