Poth P&Z rejects strip center plans; addresses growth

POTH -- An application for rezoning by Ward Richter has been rejected by the Poth Planning and Zoning Committee. This followed a public hearing Dec. 11 to address the concerns of neighbors and community members prior to the committee’s scheduled meeting.

The rezoning would have changed a portion of the Richter estate, currently zoned as an “R1 single family,” to a general business district.

The property in question is a 3-acre plot located off U.S. 181 southeast of Fahr Street. The area closest to the highway currently is zoned for general business, while the rear of the property is zoned residential.

The request for rezoning was needed for a proposed retail strip center to be constructed on the land. The strip center, according to Richter, could potentially house retail stores, offices, or other businesses. Without rezoning, the proposed center could not be built.

All available seats in the room were filled by residents of the surrounding tracts of land, who attended to listen or add to the discussion. In opposition to the change, Jackie Moczygemba read a letter of notice and concern to the committee members.

“We believe the creation of such a proposed subdivision is being done for sheer purpose of profit and in disregard for the quality of life of the surrounding families,” Moczygemba said, regarding proposed rezoning.

One by one, the residents voiced their concerns.

“I’m not happy about it,” said Shelly Weilbacher. “I’ve lived there for a long time and that’s not what I thought was going to happen when we bought that property.”

Opposition appeared mainly to stem from the presumed “open-endedness” of the change. Despite Richter’s stated intentions, the concerns expressed related to the open door for unwanted establishments potentially to appear in the future, which would be completely legal under the change.

“You need to justify getting us to approve rezoning it. I mean this was zoned residential for a reason,” said committee member LeAnn Hosek, regarding the proposal.

The application for rezoning was rejected 3-0 by the committee members; the committee will not propose the rezoning to the Poth City Council. Richter, however, retains the right to resubmit his application at a later date.

Also during the meeting, the committee reviewed plans for the proposed “Sandra’s Ridge” subdivision, submitted by the Wiatrek brothers. The subdivision, if approved, would be constructed on property currently owned by Justin Wiatrek.

Dean Bayer, the city engineer, reported to the committee regarding the proposed plans.

According to Bayer’s review of a preliminary design, the plan meets the city’s requirements for water, wastewater, and runoff, according to city code. However, the application lacked a set of final plans.

“I cannot approve a building permit at this time until I get the final plans,” Bayer said.

The application also lacked other items required by the city prior to construction; therefore, the committee withheld approval of the plans. The project cannot move forward until the final plans are provided to the city.

How come the ones with red ear lobes don't lay red eggs? I'm going to go get some chicken ear rings and give to my neighbors for their feathery girls.

4th.....I was serious about the ear lobes. White ear lobes indicate white eggs while red ear lobes indicate brown eggs. T-Bone.....You're getting downright popular. Never despair, you're still a couple cuts about chuck.

T-Bone, at least I have the courage to use my real name and hide behind some pseudonym. Once again, come see before you judge. Only one person living close has complained. Yet...they sure love their oil money flowing in.

I think you're pulling my leg about the chicken ear lobes...If they have ear lobes how come you never see any wearing ear rings?
