Letter: Development moratorium in Floresville

City council action to deny water and wastewater utilities to a local developer on March 14 in effect created a de facto moratorium against real estate development in the city of Floresville and within the extraterritorial jurisdiction (ETJ).

When considering the approval of a 17-acre parcel for Pecan Springs RV Park’s request to purchase water and wastewater services, the council voted to table the request indefinitely pending the completion of a “comprehensive water and wastewater capacity analysis.” The city manager informed the council that such an analysis has not even been started and may not be complete for a year or longer.

Denying the utility service request potentially affects all other commercial and residential growth in the city limits and ETJ until such time as the study has been completed.

The Pecan Springs project is owned by the Starnes Investment Group LLC, and is located in the Floresville Certificate of Convenience and Necessity (CCN) district, legally obligating the city to provide water and wastewater to this development project.

What we have is in fact a de facto moratorium against any future development in Floresville if water and wastewater cannot and will not be provided until this study is completed. Whether they realize it or not, the council has effectively shut down business growth, because if one development cannot get city utility services, then the others cannot either.

Furthermore, the city will not receive the tens of thousands of dollars in water and wastewater income from this project. And in addition, the city will likely incur significant new legal fees stemming from this situation.

This is not about one development project. It is about the ability of our community to grow and prosper and to compete for jobs with other nearby communities who can provide city utility services.

I understand that Floresville is currently financially insolvent with a budget deficit exceeding $350,000. Actions such as this can only exacerbate this condition.
