FLORESVILLE -- For many weeks, Floresville Parks Foundation Committee President Douglas Jones has been digging through myriad documents in an attempt to ascertain the true state of the foundation’s finances.

Jones, who was named to the committee in December, gave a report July 25 to the Floresville City Council about his progress. Jones said that during his research, he has consulted meeting agendas for both the committee and the council, bank records, and articles in the Wilson County News. His mission, he said, is “to prevent a historical repetition of errors.”

Figuring out who served on the foundation has been a challenge in itself. Jones learned that the committee’s charter members in 2009 were City Manager Andy Joslin -- who served as president and is the organization’s registered agent, according to state and federal sources -- former Councilman Johnnie Rene Gomez, Juan Perez, Keith Rodgers, and Nick Silva. But by the first Floresville Holiday Extravaganza in December 2010, the event’s brochure listed none of them as members of the committee. Instead, it listed Steven Treviño as the president, Jose Leandro as vice president, Becky Silva as secretary, and other directors including Rod Allen, Leon Payne, Steve Lucio, Joseph Treviño, Jon Payne, Dino Cantu, Thelma Gutierrez, and John Perez.

Jones said all of this activity occurred despite the foundation not being officially recognized as a corporation by the state effective June 30, 2011.

Financial records indicate that the foundation -- despite its bylaws referring to the betterment of city parks -- gave approximately $11,000 to the Girl Scouts of Southwest Texas, Jones said. Additionally, the organization has operated two separate Wells Fargo bank accounts. The first was dedicated to the extravaganza. Prior to its closure in 2011, Jones said the account had expenditures of approximately $77,000. A second account has a balance of approximately $4,000 and has not had activity in two years. But Jones said he has yet to find conclusive records of how that money entered the accounts, despite finding fragmented records of how it was spent.

“I’m still trying to find out where my checkbook is,” he said.

The city council and Joslin pledged to assist Jones in whatever way necessary to resolve the issues. This could include a possible subpoena of bank records by City Attorney Louis Rosenberg.

Jones’ latest report follows one he gave the council at its June 27 meeting, in which he informed the council that the foundation forfeited its corporate privileges with the state comptroller’s office Oct. 7, 2011, and that its business registration with the Secretary of State’s office was forfeited Feb. 10, 2012. Rosenberg is working with the committee to reclaim its 501(c)(3) status with the Internal Revenue Service, which it also has lost.

Why would you have to subpoena records that you already own... all you need is copies of past statements and copies of checks paid... it was the city's account to start with... and I am sure the bank in question still has a ... More ›
