Alleged incorrect information provided by the Wilson County Clerk’s Office has stalled a potential recount of the ballots cast Nov. 5 to determine if the county will proceed with certificates of obligation to fund several projects, including repairs to the historic Wilson County Courthouse.

The canvass Nov. 13 confirmed the 11-vote difference -- 1,243 votes for and 1,232 votes against -- from election night.

There was an increasing effort to request a recount. But that effort died, due to what Carter Thomas of Texans for Constitutional Government alleges was misinformation given by Wilson County Clerk Eva Martinez. Thomas, in a complaint filed with the Texas Secretary of State’s Office Elections Division, reported that more than the required number of voters had signed a petition to request the recount and that more than $2,700 had been collected to pay for it.

“When I met with the county clerk, I was told that I would need significantly more than the $2,720 down payment, as there would be administrative costs for the voting machine -- which the county owns -- and salaries for the county judge and/or county clerk who would be running the recount,” wrote Thomas.

Organizers later discovered that they only needed $1,700, which is why Thomas has asked the state to provide an explanation of specifically what would have been needed for the recount to go forward.

Additionally, Thomas alleges that the ballot used in the election was fraudulent, as not all of the items listed to be financed by the $8.5 million would be funded. (See “County proposal wins by 11 votes,” Nov 13.).

Thomas’ inquiry about the election follows one made by Floresville City Councilman Jim Miller, who in October filed a complaint with the Secretary of State’s Office, alleging that the proposition was “misleading, if not outright fraudulent.” As of press time, Miller said he had not received a response.

Following the Nov. 13 meeting, Martinez directed questions about why the county would not pay for the recount to County Judge Marvin Quinney.

“In an election that small, I don’t consider 11 votes to be all that close,” he said.

This is despite the ballot proposition indicating that ad valorem tax funds would be used to repay the funds and earlier remarks by Quinney that the expenditure could affect property-tax bills for the next 20 years.

As a result, Thomas and Joann Juhasz of the Wilson County Patriots are asking citizens to press lawmakers, including state Sen. Judith Zaffirini and Rep. John Kuempel, to author legislation that would require a county to foot the bill for automatic recounts following close elections.
