FLORESVILLE -- Jim Miller no longer is a member of the Floresville City Council, following his resignation Nov. 25.

Since Miller was elected to the council in the 2012 municipal election, the city has implemented an insolvency plan and the push toward a comprehensive land-use plan is ongoing. While he acknowledged that the city is in a better position because of actions of the city council taken during his time as councilman Place 1, Miller said, “But you get to a point where you have to focus on what pays the bills and [on your wife and family].”

According to a pre-trial agreement signed by Miller, his attorney Steven Hilbig, and District Attorney Rene Peña of the 81st Judicial District, Miller agreed to resign and not file for candidacy on the city council during the next regular election cycle. He also agreed not to violate any penal law, “excluding traffic offenses or similar Class C misdemeanors, for a period of six months from the date of the agreement.”

The resignation stems from Miller’s application for a place on the general election ballot, filed Aug. 13, 2012, in which Miller indicated that he had lived in the city for 5 years, 8 months and that this information was false. Miller acknowledged in the agreement that his admission might be used against him if a formal charge of Tampering with a Governmental Record is later filed against him.

In a press release, Peña said, “Mr. Jim Miller has accepted responsibility for Tampering with a Governmental Record, a state-jail felony, regarding his intentional, false statement on his application in order to be placed on the city of Floresville ballot.”

Peña also said, “At this time, this matter has been resolved in the interest of justice.”

During the course of the district attorney office’s investigation, Peña said it reviewed various pieces of information, including a recording of a 2011 city council meeting in which Miller allegedly stated that he did not reside in the city.

Eight days after Miller applied for a place on the ballot, former Floresville City Secretary Margaret Aranda -- the election judge -- filed a report with Patrolman Kevin Swinehart of the Floresville Police Department alleging that Miller falsified his application. The matter was referred to the district attorney’s office.

Miller was kept off the ballot until the Fourth Circuit Court of Appeals ordered that his name be placed on the ballot.

Then in May 2013, Miller revealed that he was the subject of a criminal investigation by Texas Ranger Cody Mitchell, which Peña had ordered.

Miller said Nov. 25 that he had hand-delivered his resignation letter -- addressed to Mayor Diana Garza, City Manager Henrietta Turner, and City Secretary Sherry Pollok -- to Floresville City Hall. Turner acknowledged that she received the letter at 10:53 a.m. and that she subsequently informed the remaining councilmen of Miller’s resignation.


Leak in City Hall?

While Garza said during a telephone interview just after noon that she had not seen the resignation letter, a Facebook page titled “FTP FloTownPolitics” made mention of it at least 30 minutes prior. Garza said she was unaware of how the information might have leaked from City Hall, but that such a breach was unacceptable.

The FloTownPolitics page -- which is liked by at least four current and former elected city officials -- long has blasted Miller for various reasons, including an alleged sexual assault investigation in Floresville. Both Turner and the Floresville Police Department have told the Wilson County News there is no such investigation.
