Alicia Pierce, the communications director at the Secretary of State’s Office, confirmed that Floresville city Councilman Eric Rodriguez recently inquired about how the city should proceed when it comes to the vacancy and selecting a successor for former Councilman Jim Miller, who resigned last month. She cited two areas of Section 201 of the state’s election code.

Miller hand-delivered his resignation -- addressed to City Manager Henrietta Turner, Mayor Diana Garza, and City Secretary Sherry Pollok -- to City Hall Nov. 25, indicating that the departure was effective immediately. According to the Election Code, the vacancy “occurs on the date the resignation is accepted by the appropriate authority or on the eighth day after the date of its receipt by the authority, whichever is earlier.”

The council voted Dec. 12 to accept Miller’s resignation. (See “Council accepts Miller’s resignation amid confusion” here: http://bit.ly/1cbYYt8.)

Pierce said the charter provisions would prevail regarding the vacancy. The city’s home-rule charter prohibits more than one appointment per 12-month period. If a second vacancy occurs, the council “shall call a special election within 10 days from the date the last vacancy occurred.”

Rodriguez was appointed to fill a council vacancy Dec. 14, 2012.

Turner sent all four remaining councilmen an email message about Miller’s resignation on the date that it was received. Therefore, eight days after its receipt would have been Dec. 3; this would indicate the city must call a special election.

Rodriguez and Garza declined to comment, while Turner could not be reached.
