FLORESVILLE -- She has been at the helm for less than three months, yet Floresville City Manager Henrietta Turner faced the threat of termination during a special Dec. 19 meeting of the Floresville City Council.

When the council reconvened in open session after having spent slightly more than an hour in closed session, Councilman Johnny Ray Nieto moved to fire Turner, effective immediately, for allegedly acting in a manner that exceeded her contractual authority. The motion was seconded by Councilman Mario Morones, who joined Nieto in favor of severing Turner’s employment.

Councilmen John W. Guerrero and Eric Rodriguez voted in opposition of the move. But according to attorney Chris Hugg of the law offices of Louis T. Rosenberg -- the city’s legal counsel -- the city’s home-rule charter requires a majority vote of the council in order to terminate a city manager. Therefore, Mayor Diana Garza was not permitted to cast a vote to break the 2-2 tie.

Garza then asked if she was permitted to comment on how she would have voted if she had been permitted to break the tie, but Hugg advised the mayor against making such a statement.

A fifth council vote was not possible, due to a vacancy that occurred as a result of former Councilman Jim Miller’s Nov. 25 resignation, which the council accepted Dec. 12. Hugg cited verbiage in the state’s Election Code, which stipulates that a vacancy “occurs on the date the resignation is accepted by the appropriate authority or on the eighth day after the date of its receipt by the authority, whichever is earlier.”

Because the date of the vacancy is less than 12 months from Rodriguez’s Dec. 14, 2012, appointment to the council, this triggers a provision within the city’s home-rule charter that requires the city to hold a special election to fill the vacancy. The council voted unanimously to call the election for May 10, 2014, in which voters will choose someone to serve the remainder of Miller’s term due to end next November.

In other business, the council voted to grant the Floresville Economic Development Corp. an exemption from a contractual requirement to install curbs on all roads within the El Rancho Grande Industrial Park on F.M. 537.

The council also voted unanimously to approve the second reading of an ordinance related to extending the 55 mph speed zone on U.S. 181 at the northern edge of the city limits. (See “TxDOT to slow U.S. 181 traffic,” Nov. 20.)
