During the late evening hours of Wednesday, April 23, inmate Luther Napoleon York, was inadvertently and erroneously released from the Bexar County Jail. Anyone with knowledge of York’s whereabouts is encouraged to call their local law enforcement agency 911(for emergencies only) or the Bexar County Sheriff’s Office Tip line at 210-335-8477.

What Happened
Luther York had been at the Bexar County Jail for just over four months awaiting a court hearing and sentencing for a burglary charge and the violation of a protective order.

On Wednesday, Luther York appeared before a Criminal District Court Judge, where his Burglary charge was dismissed and the defendant was given 8 years deferred adjudication on the Violation of the Protective Order. As a condition of the deferred adjudication, the defendant was sanctioned to 90 days in jail, with no credit for time served.

When York was returned to the jail, a misreading of the court’s order at the Booking Section of the jail, led to his inadvertent release.

What the Bexar County Sheriff’s Office is Doing Now
As a result of this error, Judge’s Warrant was issued and the Bexar County Sheriff’s Office Fugitive Apprehension Unit is actively searching for Luther York. We have contacted previous victims of York’s crimes, and alerted them of his release.

How did this happen?
We are currently investigating how this error took place. Preliminary findings suggest that a detention officer did not fully read the order from the Judge, and prepared release documents, instead of re-admitting him to jail.

The fact that erroneous releases could occur was one of our priorities from the start of this Administration. Last fall, we identified this issue as part of our strategic plan, and development of a new Jail Management System is already underway. We are currently in the design phase and scheduled to go live with this technology late this year. Although the judicial orders are entered into a common database shared by both the Bexar County Courthouse and the Bexar County Jail, there are still opportunities for mistakes to occur. Automated technology could have prevented this error, by providing an extra layer of authorization, prior to any release; however, until this automated system is fielded, it is still our responsibility to have failsafe measures... and that did not happen in this case.
