Gilmer man pleads guilty in ’12 drunk-driving crash

Benjie Burke III, 25, of Gilmer is set to return to the Wilson County District Court June 12. On that date, he will be sentenced by 81st Judicial District Court Judge Donna S. Rayes after pleading guilty April 21 to one count of intoxication manslaughter with a vehicle, according to court records.

Burke, who now faces up to 20 years in prison, was the driver of a 2012 Honda Accord Jan. 21, 2012. Officials said Burke was driving northbound in the southbound lanes of U.S. 181 near Shannon Ridge Drive north of Floresville at approximately 4 a.m. when his vehicle collided with a 1996 Honda Accord being driven by a Muskogee, Okla., man.

Killed in the crash was Burke’s passenger -- 30-year-old Justin Gregory Jones of Edmond, Okla.

Wilson County District Court also was in session April 29. On that date, the following defendants were among those appearing before 218th Judicial District Court Judge Stella Saxon:

•Samantha Cunningham, 24, of Seguin, charged with aggravated robbery, unauthorized use of a motor vehicle, and debit card abuse for her alleged role in an Oct. 3, 2013, incident at a home near the Guadalupe County line, for a pretrial hearing. She returns to court for a docket call June 3, with jury selection ahead of her trial set for June 23.

•Basilio Garcia, 30, and 40-year-old Royce Houston Smith, both charged with possession of a prohibited substance in a correctional facility for their alleged roles in a May 26, 2013, incident in the Wilson County Jail, for pretrial hearings. Each is set to return for a docket call May 14, with jury selection ahead of their trials set for May 27.

•James Jimenez, 46, and 33-year-old Agapito Rios, both charged with murder for their alleged roles in the 2008 death of 35-year-old Ricardo Lopez de la Rosa Jr. of San Antonio, each for pretrial hearings. The two are set to return to court for a docket call June 3, with jury selection ahead of their trials set for June 23.

•Jacqueline Kowalik, 50, charged with misapplication of fiduciary property totaling more than $20,000 but less than $100,000, for allegedly failing to deposit checks and cash received at Dr. Edgan “Eddie” Elizondo’s dental office on U.S. 87 in La Vernia in 2008. She attended a pretrial hearing and returns to court for a docket call June 3, with jury selection ahead of her trial set for June 23.

•Kyle McKay, 19, of Kirby, for a pretrial hearing. He is charged with murder, unauthorized use of a motor vehicle, and possession of more than 4 grams but less than 200 grams of a controlled substance in Penalty Group 1, following the November 2012 death of 22-year-old Dakota Reynolds. He is set to return for a docket call May 14, with jury selection ahead of his trial set for May 27.

•Roxie Jean Talerico, 20, of Pleasanton, charged with burglary of a habitation for her alleged role in a 2013 incident in Floreville, was set to enter a plea. That was rescheduled to May 6.
