Court to determine Kowalik’s restitution
It now will be up to a court to determine the amount of money 50-year-old Jacqueline Kowalik will be required to repay a La Vernia dental practice. A restitution hearing is set for Aug. 11, according to Wilson County District Court records.
Kowalik, during a July 23 docket call, pled no contest to one count of misapplication of fiduciary property totaling more than $20,000 but less than $100,000. According to Assistant District Attorney Audrey Louis of the 81st Judicial District, Kowalik was sentenced to 10 years’ deferred adjudication probation. Officials estimate that the former dental practice employee stole at least $38,000 from on or about Jan. 1 through June 30, 2008.
A plea agreement is in the works and court records indicate Kowalik will appear before 81st Judicial District Court Judge Donna Rayes for sentencing Aug. 11.
Also appearing in court July 23 were:
•Kyle McKay, 20, charged with murder, unauthorized use of a motor vehicle, and possession of more than 4 grams but less than 200 grams of a controlled substance in Penalty Group 1, in connection with a 2012 incident in Stoockdale. His next court appearance is a docket call set for Oct. 15, with jury selection ahead of his trial scheduled for Oct. 27.
•Maria Arismendez, 28, who pled guilty to evading arrest or detention with a motor vehicle in connection with a March 20 pursuit involving deputies from the Wilson County Sheriff’s Office. She was sentenced to three years’ deferred adjudication probation.
At least four cases are among those that could be chosen to proceed to trial. The jury scheduled for selection Aug. 4 could hear one of the following cases:
•Carter Lambeck, 36, of Stockdale, charged with failure to stop and leave information, in connection with a 2013 crash on S.H. 123 near Stockdale.
•Jerry Lee Janysek, 45, of Poth, charged with aggravated assault with a deadly weapon, retaliation, and possession of less than 1 gram of a controlled substance in Penalty Group I, in connection with the July 2013 shooting of a Poth man.
•Steven Pruski, 43, charged with aggravated assault with a deadly weapon for his alleged role in a March 11 incident outside the Circle B Gun Shop near La Vernia.
•Nicholas Moreno, 27, of Floresville, charged with aggravated assault in connection with an Oct. 31, 2013, incident in which he is suspected of punching another man, causing him to fall and strike his head on a basketball court in Legion Park in Floresville.
