A legal settlement has netted the Floresville 4A Corp. -- responsible for the Lauro G. De Leon III Floresville Event Center -- $875,532.99.

Attorney Rob Killen of San Antonio-based Kaufman & Killen reported to the 4A corporation’s board at its Aug. 12 meeting that the total award received from Greco Construction Inc. was $1.8 million. However, the net distribution came after subtracting:

•$720,000 -- 40 percent -- for attorney fees to the Gravely & Pearson law firm

•$204,467.01 in case expenses.

The suit was filed, according to court documents, when issues such as water-intrusion, roof leaks, musty odors, condensation, and cracks in exterior stucco began to surface in 2012.

Initially, when the topic of the settlement was brought up at the meeting, Killen said it was up to the board whether it wanted to disclose the details. Board member Andy Joslin said the information should be available to the public, in the interest of “being transparent” with the corporation’s finances. In a press release, 4A corporation board President Melissa Popham said, “We were very satisfied with the results and the quality of legal representation.”

The board briefly discussed uses for its legal windfall, which it wants to spend on repairing the event center. Greco was the prime contractor when the structure was built in 2010 on S.H. 97 West.

Also during the meeting, the board discussed the city’s annual home and garden show with Wesley Pfeil and Crystal Anders of Pfeil’s Home & Garden. Board Treasurer Debra Conoly had questions related to event center rental fees that were waived for Pfeil’s.

Anders said that Floresville Mayor Diana Garza and City Manager Henrietta Turner authorized waiving the fees for the event, from which Pfeil’s draws no profit. Garza, the organizer of the first show in 2010, handed over the reins after being elected mayor in 2012, leaving the home and garden center to administer subsequent shows.

Revenues from the $85 booth rental fees have been placed in an account, which Anders said holds $8,000. This year, $500 has been withdrawn from the account to purchase plants and soil used in the beautification of the “Welcome to Floresville” display at the intersection of U.S. 181 and Standish Street and the city’s veterans monument and City Hall on D Street.

Rules related to the discounts are among the items the 4A corporation plans to address as it crafts policies and procedures. Killen said he would have a draft prepared for the board’s review at its September regular meeting.

the 4a board should have created a set of rules / regulations for the event center rules of operation. if nothing else there should be a standardized contract with riders that can attached..
