FLORESVILLE -- City Manager Henrietta Turner is distancing herself from the Floresville City Council after twice walking out of an Aug. 14 closed session which she believes may have been illegal, under the provisions of the Texas Open Meetings Act.

Turner, in an interview following the meeting, said that she chose not to participate in parts of the discussion because it dealt with employee-disciplinary matters that were not mentioned on the meeting agenda, which is a violation of state law.

“I just think it was wrong,” Turner said.

According to the meeting’s posted agenda, the council was to meet in closed session to review the city’s dumpster roll-off policy, “correspondence to the mayor on enforcement and city policy towards business, management personnel response, direction for implementation, and advice considering possible litigation.”

The Texas Open Meetings Act allows a governing body to meet in closed session to seek advice from its attorney on matters of “pending or contemplated litigation” and also to discuss certain personnel matters -- provided they are mentioned on the meeting’s agenda.

Personnel matters were not listed among the subjects for the executive session.

Turner said that the city of Floresville has a full plate, as it attempts to claw its way from the grasp of insolvency. As it gains ground on its insolvency plan, the city is working to develop its public works infrastructure by creating electronic water and sewer models, moving toward repair of a water tower, and considering an interlocal agreement with Wilson County for health inspections.

“We have a whole lot more important things to talk about than if I discipline a clerk,” she said.

Mrs Turner, suggest you read Texas Code on meetings. I believe you were in the wrong on what you did. If you really understood the law, you would have stayed and made a motion to reflect your concerns.
