Floresville seeks to reverse court action

Floresville’s city council and mayor are taking legal action to reverse the 218th Judicial District court order that allowed Place 5 Councilman Jim Miller to remain on the council.

The restraining order maintains Miller’s status as a council member until the issue is addressed by the district court in a hearing set for Monday, Dec. 21.

In a plea dated Dec. 17, attorneys for the council and mayor assert the court lacks jurisdiction in the matter. The plea holds that the council and mayor acted within their discretion in declaring Miller’s council seat vacant.

A council majority contends that Miller is not a resident of the city and therefore unqualified to serve on the council. Miller claims Floresville as his residence of record.

It is precisely the Tea Party that the city council is trying to prevent from being heard at council meetings. It's not because of where they live, but it is the message that council does not want to hear.
