In advance of any district court action Dec. 21 related to Floresville City Council member Jim Miller, the city has posted an agenda that includes possible action to fill his council seat.

Floresville Mayor Sherry Castillo called for the Dec. 21 special meeting.

One item on the agenda posted Friday, Dec. 18, is to consider and/or take action on setting a date for a special election for Place 5.

Council members tabled consideration of a similar agenda item at their Dec. 14 meeting, on the advice of the city attorney.

Also, at the same meeting, the council majority voted to retain a law firm to represent the city against Miller. Attorney José Garza, representing the firm, concurred with the city attorney at the time that calling an election to fill Miller’s seat might violate the district court’s temporary injunction.

According to the state election code, Floresville has until Feb. 19, 2016, to order a special election.

All three could be recalled in a May election. It would be necessary for a petition with 500 verified signatures to be filed by the end of January to allow for the processes and for it to be placed on the May ballot!

Bob you may have a point. The Charter permits a recall of an appointed council member including the mayor. But there is a provision that the recall election cant be 6 months before the election of the member. Tejada, Ortiz,... More ›

Fed Up, Good point. But, you'd have to get the opinion of a good elections attorney (located no where near Floresville) to see if an appointed mayor can be recalled if she were just thrown into office by a city council. Might... More ›

Bob - it would also work to include a recall election. Just need to have 500 signatures of registered voters in the City of Floresville to the City Secretary by February 19.

If a special election is going to be held for Jim Miller's slot, why not include an election for Mayor as well? Doesn't cost a dime more to add another 'open' office to the printed ballots. And, there's no extra cost... More ›

So no special election for a mayor but will be one for a council seat. I don't get it!

If the city is having financial issues, they should sell tickets to the circus they call council meetings.

You know folks, I'll bet that Danny talked the Special Council he hired in November to donate the $17,000 he's owed to pay for this special election. That's just the kinda' swell guy Danny is!
