Judge quashes bid to recall Floresville mayor, councilmen

Senior Judge Dick Alcala's judgement today effectively quashes the recall of Floresville Mayor Sherry Castillo and councilmen Daniel Tejada and Juan Ortiz.

Among his findings released this evening, Alcala states that the Floresville City Council met the stipulated timelines -- for verifying and presenting the petition, and holding a hearing and a vote to set a recall election -- as specified by the city charter, but that the petition should have been filed earlier, to meet the dates for elections under the Texas Election Code.

The vote by the council March 10 to hold the recall election in November is nullified by the city charter, the judge said, as that is the date for the election for the seats currently held by the three named in the recall petition.

Reader which laws are you including when you say they must be followed. To me it sounded like retired was speaking of violation of the Open Meetings Act as an example. I dont think there is a requirement to allow that, by law.

The timeline was there. The judge ruled that the city did not break the letter of the law by dragging their feet on the recall. That's not saying much.

Not2worry, I would not gloat too much. Elections are in May, and if the right people get in, you know, the ones that really care about our city, that can change the character of the council. Don't sit back and light that cigar yet!
