The whole notion of State's rights or sovereignty was layed to rest in 1861 when President Lincoln refused to accept the legal secession of the southern states and sent his federal army into Virginia to put down what he deemed to be a "rebellion".

Later, the 14th Amendment sealed the deal and nailed the coffin shut forever on State's rights. Until it is repealed, any discussion of State's rights is a mere exercise in political futility.
