Our Mayor and the City Attorney are using the District Court System to attempt to throw the constitution out the window and strip us of our rights of free speech and a representative government!
On November 19, 1863 Abraham Lincoln in his Gettysburg Address stated "...this nation, under God, shall have a new birth of freedom -- and that government of the people, by the people, for the people, shall not perish from the earth."
The First Amendment to the US Constitution, ratified by the States on December 15, 1791 states "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances."
Our elected officials, Councilman John Guerrero and Councilman Mario Morones were elected by the citizens of this City to represent the citizens of our City. They have chosen to use their first amendment RIGHT to protest the actions of the Mayor and his cronies who insist upon bypassing the will of the voters. The petition filed with the 218th District Court by County Attorney Russell Wilson clearly states that actions of the Floresville Economic Development Corporation in incurring $2.1 Million in public debt was clearly intended to prevent a public vote on the issue. Despite this pending litigation, the Mayor continues with City Council Agenda items to approval an "interlocal agreement" that will have the City take responsibility for the operations and maintenance of of a "recreation complex".
Now, as the Mayor has been unable to force this issue to a vote amongst the Council he chooses to take this issue to Court and asks a judge to intervene into the business of our elected officials. He further asks the court to deny the First Amendment right of these elected officials and force them to attend a meeting and to vote on an issue that is at the very least controversial. Obviously the Mayor does not care about the opinions of these Councilmen or the Citizens but simply a quorum that will allow him and his cronies to adopt and pass resolutions that achieve their own personal agendas. Agendas that clearly will bypass the will of the people of our City.
The Court hearing is scheduled for 9:00 a.m. in District Court here in Floresville and will cost the taxpayers of the City of Floresville, not the Mayor, well in excess of $10,000.00 in legal fees alone. Furthermore, these actions, initiated by the Mayor and City Attorney, will strip us of specific rights guaranteed by the Constitution and allow for the ruling of a government of ONE (The Mayor).
We the People, as citizens of the United States, citizens of the State of Texas, citizens of the County of Wilson, and citizens of the City of Floresville can not stand by and allow this to happen. This is OUR CITY, OUR GOVERNMENT and MOST IMPORTANTLY OUR TAX DOLLARS. Now is the time to take back and return OUR CITY government to a government OF THE PEOPLE, BY THE PEOPLE, AND FOR THE PEOPLE!
