Letís be sure that we are being clear here. Congress allows a Church to make a choice. It can pay itís fair share of taxes, and if it does, it has all the rights of any other legal entity. And that includes full free speech rights. But Congress also allows a Church to avoid paying itís fair share of taxes, but the trade off is that the Church agrees to give up some of itís free speech rights. The big problem is we are now seeing greedy pastors who think they are above the Law and want to shirk both paying their fair share of taxes and abiding by the Law.
